Regulatory framework

Ukrainian residential construction is governed primarily by the Law 'On regulation of urban-planning activity' (Закон України про регулювання містобудівної діяльності) together with the Державні будівельні норми (ДБН) — the State Building Norms. The relevant ДБН for single-family housing include ДБН В.2.2-15 (residential buildings), ДБН В.1.1-7 (fire safety) and the energy-performance norms in ДБН В.2.6-31 with thermal-protection coefficients per climatic zone.

Before design starts you typically need містобудівні умови та обмеження (МУО) — the municipal urban-planning conditions and constraints — issued by the local self-government authority based on the local плани зонування / детальні плани території. The МУО fix the permissible footprint, height, density and use, and the architect designs strictly inside that envelope.

For low-rise single-family houses up to roughly 500 m² the procedure can run as a будівельний паспорт rather than a full project, which is substantially faster — the budynkovyy pasport packages a simplified architectural-planning solution with site plan and identification documents. The exact threshold is set by the Ministry of Communities, Territories and Infrastructure and is reviewed periodically; current practice is to use the паспорт track wherever the project envelope permits.

Once the project is ready and the permit pathway chosen, construction can start after submitting a повідомлення про початок виконання будівельних робіт (notification of commencement) to ДІАМ — the State Inspection of Architecture and Urban Planning. For more complex categories (CC2, CC3) a дозвіл на виконання будівельних робіт (construction permit) is required instead of a simple notification.

Energy performance is verified against ДБН В.2.6-31 thermal-protection and ДСТУ-Н Б В.2.5-37 on energy efficiency, with a class assignment that today drives both the permit pathway and the post-completion energy certificate. Note: rules continue to evolve during and after martial-law conditions, and some procedural steps have been temporarily simplified — we verify the current state with the relevant authority for each brief.

Designing before the МУО is in hand

Drawing a house before the містобудівні умови та обмеження have been issued frequently means redesigning footprint or height once the МУО arrives. We hold the architectural solution back until the МУО envelope is confirmed.

Missing the engineering-geological survey

ДБН А.2.1-1 requires інженерно-геологічні вишукування for most foundations. Skipping them leads to expensive surprises at foundation pour time — peat lenses, perched water tables, or undeclared fill on the cadastral parcel.

Choosing the wrong category of complexity (CC)

The CC1 / CC2 / CC3 split decides between a simple notification and a full construction permit. A house that crosses a CC threshold (height, span, occupant count) but is filed as CC1 will be rejected at ДІАМ — and the timeline restarts from scratch.

Underestimating thermal-protection for the climatic zone

Ukraine spans four climatic zones (I–IV) with different ДБН В.2.6-31 thermal-protection requirements. A wall build-up that passes in zone I will fail in zone IV. We verify the thermal calculation against the actual project location, not against a generic template.

Overlooking access and engineering networks in the МУО

Who can sign the dossier

In Ukraine the project documentation must be signed by an architect holding a valid сертифікат відповідального виконавця окремих видів робіт у будівництві (architectural chief design competence certificate).
